Your rights
When your debts do not fit your income, the law is on your side too.
Lei 14.181/2021, Brazil鈥檚 over-indebtedness law (Lei do Superendividamento), protects the existential minimum: the part of your income you need to live on. If you cannot pay your consumer debts without compromising that minimum, you can ask for a joint restructuring of them, with your creditors brought together in a plan that fits your budget. Home financing, loans secured by collateral, rural credit and debts taken on in bad faith are excluded. Taxes and child support or alimony are not consumer debts and follow their own rules. The law does not forgive debt or guarantee a discount: it organizes the negotiation. PlanoQuita points out these rights when your situation calls for it and shows your debts in an organized list, but it is not legal advice, does not negotiate for you and does not broker agreements.
